Frequently Asked Questions

Why Should I Purchase Professional Liability Insurance?

ADR professionals face the risk of professional liability claims based on multiple factors, including conflict of interest, misrepresentation, and negligent advice. When confronted with the threat of a potential claim, many have some level of immunity, however, not all jurisdictions grant full immunity for ADR services. Even if ADR professionals avoid liability, they may incur significant defense costs and should make sure they have appropriate professional coverage to protect their assets.

Should I apply for an ADR policy if the majority of my practice is ADR, but I also provide legal representation to a few clients?

If your practice is less than 100% ADR services, you should apply for coverage through our lawyers' professional liability insurance application process. MLM's lawyers' professional liability policy provides the necessary coverage and applies premium credits for the ADR segment of the practice. Attorneys who have lawyers' professional liability insurance, and practice less than 100% ADR services, should review their insurance to verify coverage for their ADR services.
