ADR professionals face the risk of professional liability claims based on multiple factors, including conflict
of interest, misrepresentation, and negligent advice. When confronted with the threat of a potential claim,
many have some level of immunity, however, not all jurisdictions grant full immunity for ADR services. Even if
ADR professionals avoid liability, they may incur significant defense costs and should make sure they have
